Project X Data Outage Disclaimer
Lucid Trading Group LLC (the “Company,” “Lucid,” “we,” or “us”) utilizes independent third-party providers, including Project X (collectively, “Third-Party Providers”), to deliver certain data and technology used with the Website, Software, and/or Services. Project X is not owned, controlled, or maintained by the Company.
To the fullest extent permitted by law, the Company shall not be responsible or liable, whether in contract, tort, or otherwise, for any loss, damage, cost, or expense arising out of or in connection with any outage, interruption, delay, inaccuracy, malfunction, or other instability associated with Project X or any other Third-Party Provider. Without limiting the generality of the foregoing, this includes individual or system-level disruptions in data feeds, charting discrepancies (including blank or missing candles), execution delays, connectivity failures, or other issues beyond the Company’s direct control.
The Client acknowledges and agrees that:
- Project X operates independently of Lucid, and Lucid does not warrant or guarantee uptime, stability, accuracy, or availability of Project X systems.
- Refunds, credits, adjustments, or compensation will not be provided by the Company for outages or technical failures attributable to Project X or other Third-Party Providers.
- Any corrective action related to a Project X event will be handled solely in accordance with Project X’s official guidance and recommendations. Lucid will not take independent corrective actions beyond the scope of that guidance.
- Use of the Website, Software and/or Services remains subject to Lucid’s Terms of Use and Disclaimer of Liability, Refunds and Chargeback Policy.
To the fullest extent permitted by law, in no event shall the Company’s aggregate liability exceed the greater of one hundred dollars ($100.00).
By continuing to use the Website, Software, and/or Services—and by completing checkout—the Client expressly acknowledges and accepts the risks associated with Third-Party Providers (including Project X) and agrees to the foregoing terms.
